TDIU Appeals & SMC-S Decision Review
Receiving TDIU does not necessarily resolve every issue in your VA decision.
Oakridge Claims reviews the basis for unemployability, separate disability ratings, denied secondary conditions, and effective dates to assess whether an unresolved appeal or SMC-S question warrants further review.

When TDIU can matter for SMC-S
Under 38 CFR § 3.350(i), SMC-S requires a single service-connected disability rated as total, plus either separate qualifying disabilities independently ratable at 60% or more, or permanent housebound status due to service-connected disabilities. A combined 100% rating alone does not meet the single-total-disability requirement.
TDIU based on one disability
Under Bradley v. Peake, TDIU based on one service-connected disability can satisfy the total-rating requirement. For the separate-60% route, the other disabilities must be separate and distinct, involve different anatomical segments or bodily systems, and independently combine to at least 60% under VA rules. The same disability cannot be counted twice.
TDIU based on several disabilities
Disabilities grouped as “one disability” for the percentage thresholds in § 4.16(a) are not automatically one disability for SMC-S. Buie v. Shinseki addresses VA’s duty to maximize benefits, including considering whether one disability independently supports TDIU. That is a fact-specific review, not an automatic award.
The separate factual-housebound route
This route does not require the additional 60% ratings, but the single-total-disability requirement still applies. VA evaluates whether service-connected disabilities substantially confine the veteran to the dwelling and immediate premises, or ward or clinical areas if institutionalized, with confinement reasonably certain to continue throughout life. TDIU alone does not prove housebound status; leaving home for medical care does not by itself settle the question.
What the decision and code sheet may show
These are review signals in existing records—not a list of conditions to claim or a filing blueprint.
The decision awards TDIU but does not discuss SMC-S.
The basis for TDIU and any separate service-connected ratings may raise an SMC-S question. Omission alone does not establish entitlement or an earlier effective date.
The unemployability finding refers to several disabilities together.
TDIU based on multiple disabilities generally does not satisfy the single-total-disability requirement. Grouping disabilities as one for § 4.16(a)'s threshold is not the same as one disability for SMC-S.
The code sheet lists other ratings during the TDIU award period.
VA examines whether separate, distinct disabilities independently combine to at least 60%, without reusing the disability supporting the total rating. The applicable dates matter.
A secondary condition was denied, or an existing rating or effective date remains disputed.
Being paid at the 100% rate does not resolve every service-connection or rating issue. The legal basis, evidence, review deadlines, and possible SMC consequences are evaluated individually.
An evidence-based review, not an automatic new claim
Review considers the decision history, code sheet, VA and private treatment records, employment evidence, lay statements, and medical opinions where relevant. Additional evidence may need development in a review lane that permits it; Higher-Level Review does not accept new evidence. Earlier entitlement and the date payment begins are separate questions.
Case evaluations are free; if an appeal is appropriate, representation is handled under our standard 20% contingency fee agreement with no upfront cost.
