    Common questions

    Which VA appeal lane should I choose?
    If the evidence needed is already in the file and the error is in how it was read, Higher-Level Review (VA Form 20-0996) is the lane — it is a de novo review by a senior reviewer on the same record, and no new evidence is allowed. If you have or can obtain new and relevant evidence, a Supplemental Claim (VA Form 20-0995) is the lane under 38 CFR § 3.2501. If you want a Veterans Law Judge to decide, a Board appeal (VA Form 10182) is the lane, with three dockets: direct review, evidence submission, and hearing.
    How long do I have to appeal a VA decision?
    One year from the date of the rating decision notice for a Higher-Level Review, Supplemental Claim, or Board appeal. Filing within that year preserves the effective date of the original claim. A Supplemental Claim can be filed after a year, but the effective date generally becomes the date of that filing.
    Can I file more than one lane at the same time?
    Not on the same issue at the same time. You choose one lane per issue, though different issues in the same decision can go different ways, and you can move to another lane after a decision issues in the first.
    What if VA proposed to reduce my rating?
    A proposal is not an appeal situation yet. Under 38 CFR § 3.105(e) you have 60 days to submit evidence and 30 days to request a predetermination hearing, and payments continue during those periods. Responding within those windows is the priority.
