Q: What are the 2026 VA sleep apnea rating changes?

VA proposed a revised diagnostic code for sleep apnea that tightens the CPAP-based 50% rating criteria and adds functional-impact criteria. As of publication, the changes are proposed — veterans currently rated 50% for CPAP use retain that rating under 38 CFR § 3.951 (protected ratings) once stabilized for the required period. New claims are evaluated under the criteria in effect at the time of the rating decision.
