    TPD Student Loan Discharge for 100% P&T Veterans

    Who qualifies

    • Federal Direct Loans, FFEL loans, and Perkins Loans held by the U.S. Department of Education.
    • TEACH Grant service obligations (separate process).
    • Eligibility based on a VA rating of 100% service-connected, — or granted on a permanent basis.
    • Discharge is not available based on a non-permanent 100% scheduler rating that is subject to future reduction.
    • Private student loans are not covered — discharge depends on the private lender's policy.

    How the 2021 automatic discharge works

    In August 2021 the Department of Education and VA implemented an automatic data match. VA shares the names of veterans with qualifying 100% ratings with the Department of Education. The Department's TPD servicer (Nelnet) identifies federal loans held by those veterans and initiates discharge automatically.

    Eligible veterans receive a and, in most cases, do not have to take any action. The discharge is final — unlike pre-2021 TPD discharges, there is no longer a three-year monitoring period for veterans (the monitoring period still applies for non- SSA-based TPD discharges).

    How to apply if you weren't automatically identified

    1. Gather your VA award letter or VA decision showing 100% status (or permanent ).
    2. Apply through disabilitydischarge.com (the official Department of Education TPD portal operated by Nelnet) or call 888-303-7818.
    3. Submit the TPD discharge application along with documentation of the VA rating. VA Form 21-0958 is not required — the discharge letter or My VA Health summary is sufficient.
    4. Nelnet processes the application and notifies your loan servicers to suspend collection while it is under review.
    5. Once approved, all outstanding federal student loan balances are discharged.

    What about private student loans?

    TPD discharge only covers federal loans held by or guaranteed through the Department of Education. Private student loans (Sallie Mae, Discover, SoFi, refinanced loans, etc.) are governed by each lender's individual disability discharge policy. Some private lenders offer total-disability discharge; others do not. Contact the lender directly to ask about their policy.

    Important: veterans considering refinancing federal loans into a private loan to lower their interest rate should weigh that against losing TPD discharge eligibility. Once refinanced privately, the loan is no longer eligible for federal TPD discharge.

    Tax treatment

    Federal income tax: The Tax Cuts and Jobs Act of 2017 excluded TPD-discharged student loan amounts from federal taxable income through 2025. The American Rescue Plan Act of 2021 broadened the exclusion. As of 2026, Congress would need to extend the exclusion to keep federal tax treatment consistent — check the current status with a tax advisor.

    State income tax: Most states follow federal treatment, but several do not automatically conform. Check your state Department of Revenue guidance or speak with a tax preparer in the year of discharge.

    Other benefits tied to 100% P&T

    • healthcare coverage for spouse and dependents (separate enrollment).
    • (Dependents' Educational Assistance) for spouse and children.
    • Survivors Benefits () eligibility if the later dies from any cause (subject to length-of-rating rule).
    • State property tax exemptions (vary widely by state — see /states for state-by-state summaries).
    • Commissary and exchange privileges, Space-A travel access, and other federal/state benefits.
