What happens when VA proposes to reduce my rating?

Details

• Evaluations in effect five years or more are governed by the stabilization rules in 38 CFR § 3.344, which require sustained material improvement under the ordinary conditions of life.
• Evaluations continuously in effect 20 years or more are protected from reduction except on a finding of fraud (38 CFR § 3.951(b)).
• Total ratings require material improvement actually shown (38 CFR § 3.343(a)); TDIU requires clear and convincing evidence of actual employability (§ 3.343(c)).
• A final reduction is a rating decision and carries the ordinary one-year AMA review options.
