SMC-S: Housebound Compensation
The two paths to SMC-S
Path 1 — Statutory housebound: 38 U.S.C. § 1114(s) authorizes when the has one service-connected disability rated 100% disabling and additional, separate service-connected disabilities independently rated 60% or more. The 100% and the 60% cannot be the same condition or include the 100% disability in the 60% combination.
Path 2 — Factual housebound: is also payable when the is permanently and substantially confined to the immediate premises due to service-connected disability, even without the 100% + 60% combination.
What 'substantially confined' means
VA does not require the be literally unable to leave the home — short trips to medical appointments or religious services do not defeat the . The standard is whether the disability substantially restricts the veteran's ability to leave the immediate premises on a regular basis.
The 's decision in Howell v. Nicholson and follow-on guidance make clear that occasional outings for medical care do not break housebound status.
TDIU and SMC-S
